Real estate, construction and development projects in Poland

I advise investors, developers, contractors and property owners. My engineering degree and studies in real estate valuation help in cases where technical documents and expert opinions decide the outcome.

Real estate

  • Due diligence before a purchase: land and mortgage register, encumbrances, easements, local zoning plan.
  • Preliminary agreements and preparation of the transaction for the notarial deed.
  • Co-ownership disputes, easements and adverse possession.
  • Zoning decisions, building permits, appeals and complaints to the administrative courts.

I have handled, and continue to handle, cases related to the Warsaw Decree of 1945 (the so-called Bierut Decree) and other legacy issues from the communist era: expropriations, takeovers by the State Treasury and unresolved title to land.

Development projects

Before founding my own practice I headed the legal department of a property development group. I support developers at every stage: land acquisition, permits, contracts with general contractors, sales under the Polish Developer Act of 2021, handover of units and of the building to the owners' community.

I draft reservation and development agreements and agree their wording directly with the notary who prepares the deed. For individual buyers, I review a development agreement before signing — unless I advise the developer on that project.

Construction disputes

  • Construction contracts: drafting, negotiation and review.
  • Contractual penalties and delays.
  • Defects, statutory warranty and guarantee.
  • Subcontractor claims and the investor's joint liability.
  • Court cases with expert witnesses: questions to the expert and objections to the opinion.

Where a case needs technical analysis or a valuation, I work with experienced civil engineers and certified property valuers who prepare private expert opinions.

In construction and commercial disputes I also take part in mediation together with the client, as their representative. It is often faster and cheaper than litigation, especially when the project has to be completed.

Housing cooperatives and owners' communities

Ongoing advice for management boards: resolutions and general meetings, defence in cases challenging resolutions, contracts, and recovery of unpaid charges.

Frequently asked questions

Can a foreigner buy property in Poland?

Citizens and companies from the European Economic Area and Switzerland generally do not need a permit. Other foreigners usually need a permit from the Minister of the Interior to buy land, but not to buy an apartment. Agricultural land is subject to separate restrictions. I check the rules for your specific case.

Do you work with technical experts?

Yes. I cooperate with civil engineers and certified property valuers who prepare private expert opinions for the client.
